These Terms & Conditions (the “Terms”) govern your access to and use of the SELLFISHGLOBAL platform, including the website, mobile applications, and any related services (the “Platform” or “SELLFISHGLOBAL”). The Platform is operated by SELLFISHGLOBAL.COM .  

 

PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THE PLATFORM, YOU ACCEPT AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE WITH ANY PART OF THE TERMS, DO NOT USE THE PLATFORM.  

 

1) Definitions  

 

“User” means any person or entity that uses the Platform, including but not limited to Buyers, Sellers, and App/Platform Visitors.  

“Buyer” means a User who purchases seafood products via the Platform, all trade wil be direct with the Seller off site on a B2B basis .  

“Seller” means a User who offers seafood products for sale via the Platform.  

“Transaction” means any purchase, sale, or other exchange of seafood products or related services through the Platform.  

“Content” means all text, images, audio, video, data, and other materials uploaded, posted, or otherwise made available on the Platform.  

“Parties” means SELLFISHGLOBAL and the User, collectively.  

 

2) Eligibility  

 

You must be at least 18 years old and have the legal capacity to enter into these Terms.  

You must provide accurate, current, and complete information during registration and as prompted by the Platform.  

Certain features may require verification of identity, licenses, business registration, or permits relevant to seafood trading and safety compliance.  

 

3) Account Registration and Security  

 

Create an account to access the Platform’s features. You must keep your login credentials confidential and promptly notify us of any unauthorized use.  

You are responsible for all activity that occurs under your account, including transactions initiated by third parties using your credentials.  

We may suspend or terminate accounts that breach these Terms, are suspected of fraud, or pose a risk to others.  

 

4) Use of the Platform  

 

The Platform enables Buyers and Sellers to connect, negotiate, and complete Transactions. SELLFISHGLOBAL is not a party to each Transaction unless expressly stated.  

You agree to comply with all laws applicable to seafood safety, import/export, labeling, traceability, and environmental regulations in the jurisdictions involved.  

Prohibited conduct includes, but is not limited to:  

  Listing non-sustainable, illegal, stolen, endangered, or mislabelled seafood.  

  Misrepresenting species, origin, weight, freshness, or spoilage status.  

  Engaging in fraud, price manipulation, or collusion.  

  Misusing another user’s data or trademarked content.  

We may provide tools for rating, reviews, and disputes; these do not constitute guarantees of product quality or safety.  

 

5) Listings and Transactions  

 

Sellers are responsible for the accuracy and legality of their listings, including species, price, quantity, origin, harvest method, and certifications (e.g., MSC, ASC, HACCP) where applicable.  

All seafood trades must comply with applicable import/export controls, health certificates, catch documentation, and food safety standards.  

Payments:  

  We may offer escrow,payment in the future for processing, or other payment services. Terms of payment will be described at the point of transaction.  

  Buyers and Sellers are responsible for fees disclosed on the Platform (subscription, listing fees, )  

 

Shipping and logistics:  

  Sellers must use appropriate, approved packaging and comply with cold-chain requirements for the relevant country where necessary.  

  Estimated delivery times are provided for planning purposes; actual times may vary, and be negotiated of site B2B.  

 

  The risk of loss transfers as specified in the transaction terms; you should review carrier responsibilities and insurance options.  

 

6) Intellectual Property  

 

The Platform and all its Content, including logos, trademarks, design, and software, are owned or licensed by SELLFISHGLOBAL and/or its licensors.  

You may use the Platform solely for its intended purpose and in accordance with these Terms. You may not reproduce, modify, distribute, or create derivative works without our consent, except as expressly permitted.  

If you submit Content (e.g., product listings, photos, reviews), you grant SELLFISHGLOBAL a non-exclusive, royalty-free license to use, display, and modify such Content to operate and promote the Platform.  

 

7) Privacy and Data Protection  

 

Our Privacy Policy explains how we collect, use, and share your information. By using the Platform, you consent to our data practices as described.  

You are responsible for compliance with applicable data protection laws when handling personal data of other users or customers.  

 

8) Compliance and Safety  

 

Sellers must ensure that all seafood offered for sale complies with applicable food safety laws, labeling requirements, and catch documentation.  

Sellers must maintain records necessary for traceability, including source, harvest date, vessel, and handling practices, as required by law.  

USE OF SPECIFIC SAFETY CERTIFICATIONS: If you promise or indicate certain certifications (e.g., ECO-labelled, country of origin), you must maintain current documentation and provide it upon request.  

 

9) Fees and Billing  

 

Fees for using the Platform are as described on the Platform (subscription tiers, listing fees, commission on sales, payment processing fees, etc.).  

Taxes: You are responsible for any applicable taxes arising from your use of the Platform and Transactions.  

Refunds: The Platform may offer refunds or chargebacks as described in the Refund Policy (see Section 12).  

 

10) Disputes and Resolution  

 

If a dispute arises between Buyers and Sellers, you should carry out off site B2B .  

We may provide mediation tools, escrow holds, or assistance in resolving disputes in the future , but we do not guarantee product listings .  

If needed, disputes may be resolved through binding arbitration or court, as described in the Governing Law and Jurisdiction section.  

 

11) Limitation of Liability  

 

To the maximum extent permitted by law, SELLFISHGLOBAL shall not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the Platform or Transactions.  

Our total liability to you for any claim arising out of these Terms is limited to the greater of amount paid by you to SELLFISHGLOBAL in the 12 months prior to the incident where permitted by law.  

This section does not exclude liability for gross negligence, willful misconduct, fraud, or death or personal injury caused by our gross negligence or willful misconduct.  

 

12) Indemnification  

 

You agree to indemnify, defend, and hold harmless SELLFISHGLOBAL and its affiliates, officers, directors, employees, and agents from and against any claims, losses, damages, costs, or expenses (including reasonable attorney’s fees) arising from your use of the Platform, your breach of these Terms, or your violation of any law or right of a third party.  

 

13) Termination  

 

You may stop using the Platform at any time.  

We may suspend or terminate your account, or restrict access to the Platform, for violation of these Terms, safety concerns, or as required by law.  

Upon termination, the licenses granted herein shall terminate, and access to certain features may be restricted.  

 

14) Changes to the Terms  

 

We may modify these Terms from time to time. If changes are material, we will provide notice via the Platform or email.  

Your continued use of the Platform after changes become effective constitutes acceptance of the updated Terms.  

 

15) Third-Party Links and Services  

 

The Platform may contain links to third-party sites or services. We do not endorse and are not responsible for their content or practices.  

Your interactions with third parties are solely between you and the third party.  

 

16) Export Controls  

 

You must comply with all applicable export, re-export, and sanctions laws and regulations in connection with your use of the Platform and any Transactions.  

 

17) Governing Law and Jurisdiction  

 

These Terms are governed by and construed in accordance with the laws of United Kingdom, Any disputes arising out of or in connection with these Terms or the Platform shall be resolved in the courts of the Untied Kingdom unless otherwise required by applicable law or an arbitration clause.  

 

18) Insurance and Risk Allocation  

 

Sellers should maintain appropriate liability insurance for their activities and products.  

The Platform may offer optional insurance in the future or risk management programs; terms will be provided if available.  

 

19) Force Majeure  

 

Neither party is liable for delays or failure to perform caused by events beyond reasonable control (natural disasters, pandemics, government action, etc.).  

 

20) Miscellaneous  

 

Entire Agreement: These Terms, together with any policies referenced herein (Privacy Policy, Refund Policy, Seller/Vendor Policies), form the entire agreement between you and SELLFISHGLOBAL.  

If any provision is unenforceable, the remaining provisions will remain in full effect.  

No waiver of any term shall be deemed a further or continuing waiver unless stated otherwise in writing.  

 

21) Special Provisions for Marketplaces  

 

Compliance: Sellers must verify harvest source, species authenticity, and compliance with local and international regulations (e.g., CITES where applicable).  

Traceability: SELLFISHGLOBAL may require batch tracking data and documentation to verify origin and safety.  

Sustainability: If you advertise sustainability claims, you must adhere to credible certifications and avoid greenwashing.  

 

22) Privacy and Communications Preferences  

 

You agree to receive messages via email, push notifications, or other channels.  

You may opt out of marketing communications where permitted by law.  

 

23) Data Deletion and Account Decommission  

 

You may request data deletion or account deactivation in accordance with applicable data protection laws and our Privacy Policy. Some data may be retained for legal reasons or to fulfill regulatory obligations.
